A separate federal criminal complaint had been filed against Kyle Wagner on February 3, 2026 — four months before his arrest. A federal magistrate judge in Detroit had signed it. Wagner knew. He kept posting. He kept organizing. He kept threatening. And when HSI agents came for him on June 16, 2026, he was wearing a black hoodie with three words across the chest: "I'M ANTIFA!"
That was not an accident. That was the last post.

Kyle Wagner is a Minneapolis resident who built a public identity as an Antifa organizer through social media. His Instagram accounts — @kaos.follows and later @antifa.kaos — became a real-time broadcast platform for calls to action against ICE agents during January 2026. His posts ranged from tactical instruction to outright death threats. His largest single post received 25,900 likes.
He was not operating from the shadows. He used his real name on Facebook. He showed his face on every video. He posted his Venmo, Cashapp, and PayPal accounts and solicited donations. He told his followers exactly where he was and what he was doing. He wore a bulletproof vest on camera. He handed out gas masks from the back of his truck in broad daylight. He described himself, repeatedly and without hesitation, in the same three words: "I am Antifa."
That public visibility became the foundation of the federal case against him. HSI Special Agent Rudy S. Lara, temporarily assigned from Dallas to St. Paul, reviewed WAGNER's social media record post by post. The resulting affidavit — 31 pages, sworn before a federal magistrate judge in Detroit — documents Wagner's escalation from January 8 through January 29, 2026, with verbatim quotes, like counts, and timestamps. Every word Wagner posted became evidence.

Wagner is unique among all 15 DAMN defendants. Every other defendant faces charges only in the District of Minnesota. ● Key Distinction
Counts Two and Three charge threats against federal officers — that is conduct shared in spirit with the broader DAMN conspiracy. The Michigan complaint charges threats against a private civilian — J.S. had no government role, no law enforcement connection, no public position. He was a 26-year-old private citizen who expressed support for ICE. Wagner published his parents' home address on Instagram and said "See you soon." That charge stands completely apart from every other defendant in this case.

On January 29, 2026, Wagner did something that had nothing to do with federal officers or immigration enforcement. He found a private 26-year-old citizen — identified in the federal complaint only as J.S. — who had publicly expressed support for ICE. Wagner published J.S.'s personal information on Instagram to his tens of thousands of followers and accompanied it with a personal threat.
This is the specific conduct that produced the Michigan complaint — filed February 3, 2026, just five days later — making Wagner the subject of active federal proceedings in two separate district courts simultaneously. The Michigan case is not about ICE operations. It is about a private American citizen whose home address was published online by a man who then told his followers: "We can all knock on strangers doors."

with a Personal Threat — "See You Soon Kiddo"
On January 29, 2026, using his Instagram account @antifa.kaos, Wagner published a post containing the following personal information about J.S.:

• Phone number with area code
• Home address — Oak Park, Michigan 48237
Wagner called J.S. a "bb nazi boy" in the same post.
Wagner later admitted on video that he had doxxed J.S.'s parents' house — not J.S.'s own address. He also discussed fighting J.S. in a cage fight.
Special Agent Lara concluded Wagner used Instagram with intent to kill, injure, harass, intimidate, or place J.S. under surveillance — causing, or reasonably expected to cause, substantial emotional distress. Wagner also transmitted in interstate commerce a communication containing a threat to injure J.S.

NFA is withholding J.S.'s full identifying information. Wagner published it publicly. Federal prosecutors have charged that publication as cyberstalking. J.S. is a private civilian who has not been charged with any offense. His personal information will not be republished here.

A federal criminal complaint had been filed against Wagner on February 3, 2026. A federal magistrate judge in Detroit had signed it. Wagner knew. The main conspiracy indictment was filed June 11, 2026 — under seal. Wagner may or may not have known that was coming.
When HSI executed the arrest warrants on June 16, 2026 — five days after the indictment was filed — they found Wagner wearing a black hoodie with "I'M ANTIFA!" printed across the chest. He also had multiple Antifa patches at his residence, recovered during the search warrant. Federal law enforcement photographed the arrest. The image was published by news outlets within hours.
He had said it on every video. He had printed it on a patch recovered from his home. And on the day federal agents came to his door, he wore it on his chest. Whatever else the jury ultimately decides about the charges — that image already told the story he wanted to tell.

Physical evidence recovered from Wagner's residence during the federal search warrant. The patch reads "ANTIFASCHISTISCHE" in Gothic lettering — an internationally recognized Antifa symbol. Consistent with Indictment Paragraph 88: "WAGNER wore a sweatshirt that had 'I'm Antifa!' on the front. WAGNER possessed multiple Antifa patches at his residence." Of all 15 defendants in the Operation DAMN conspiracy, Wagner alone was charged in a separate federal court. Every other defendant — Sant, Kennedy, Doyle, Robinet, Davis, Apland, Van De Water Davis, Thoreson, Kim, Stewart, Misterek, Beisell, Morgan, Rakotz — faces charges only in the District of Minnesota.
Wagner faces charges there and in the Eastern District of Michigan. The Michigan case is about something none of the others did: targeting a private citizen who had nothing to do with immigration enforcement, finding his parents' home address, publishing it to tens of thousands of followers, and saying "See you soon."
